2012 Employment Poster Guide

Oregon employers must display required state and federal employment posters in their workplace. For 2012, there are three revised state posters and one revised federal poster. There is also a new federal poster that you may or may not be required to post on April 30, 2012.

This is our 10th annual employer guide to required posters. You can use this guide to easily determine if you are displaying the required posters. We assembled all of these notices in one place so you can easily download what you need. This free guide is available at the link below.

NLRB Union Organizing Poster

The National Labor Relations Board (NLRB) adopted a rule requiring non-union employers to post a notice essentially encouraging employees to form unions. This was discussed in our New NLRB Poster Rule article. This is the first in a series of NLRB gone WILD articles. This rule has resulted in several lawsuits and multiple postponements of the compliance date. At this point, you are not required to post the notice until April 30, 2012.

The NLRB rule may very well be reversed or overruled. Still, professional poster publishers are advertising that this is a required poster. I saw one ad charging $19.95 to receive this notice.

If and when the poster is required, we will amend the poster guide and make the new poster available for download at no charge. Or, simply follow LegalBriefs for updates.

The Missing Poster

As reported in 2011, an Oregon statute requires you to post information about Oregon’s employer gag rule. The state Labor Commissioner, however, has refused to publish a sample poster. Since there is no state sample, this requirement has been missed by commercial publishers. This does not matter. You still must post the required notice or you will violate the Oregon statute.

A notice you can use to comply with the gag rule is included in our current employment poster guide.
